
| Fantasia Stares Down Potential 'Adultery' Lawsuit ? | |

| While the prospect of being sued for disrupting one's marriage sounds far fetched, it can and may be done when it comes to American Idol winner/reality star Fantasia's alleged relationship with a married man. According to sources speaking with MTO, Antwaun Cook's wife, the woman who is legally tied to Fantasia's rumored boyfriend is seriously considering a lawsuit. Because the case is a complex one, we did our research finding that North Carolina is in fact a state where a spouse may sue and recoup damages for adultery. The burden of proof is however on that spouse to prove that the previously successful marriage was disrupted by the presence of another. "Criminal Conversation is a civil action brought for adultery. It is what’s called a strict liability action in that if your spouse has sexual relations with a third party, then that third party has committed Criminal Conversation and civil damages may be sought, even if you and your spouse are already separated," a North Carolina based firm states. Neither Fantasia or Cook have issued a statement regarding the status of their relationship, which has been featured on blogs including TheYBF.com, Necole Bitchie and Honey Magazine since late 2009. While Fantasia denied a relationship with Cook at first, she recently told PEOPLE magazine "He’s a good friend, and he is not with his wife." Not commenting further on the relationship, Fantasia went on to say "Right now I’m committed to my career. I’m not trying to be in a deep relationship.
